1. About these Terms

These Terms & Conditions apply to the website www.thbd.com.au and to products, courses, digital resources and services offered through The Healthy Building Designer.

The Healthy Building Designer is operated by Taluma Pty Ltd in Queensland, Australia.

By accessing this website or purchasing or using our products or services, you agree to these Terms. If you do not agree, please do not use the website or purchase our products or services.

2. General information and professional boundaries

The Healthy Building Designer provides building and interior design education, general information and design-related services about healthier, more inclusive and sustainable environments.

Our website, courses, guides, articles, social content, downloads and other educational materials do not provide medical, psychological, allied-health, legal or other regulated professional advice unless we expressly state otherwise and the advice is provided by an appropriately qualified professional.

Information about lighting, indoor air quality, acoustics, materials, sensory load, environmental triggers, biophilic design and other environmental factors is intended to help users make informed design choices.

It does not diagnose, treat, cure or prevent a medical condition and does not guarantee any health, symptom, behavioural, productivity or wellbeing outcome.

Individual circumstances and responses vary.

For medical concerns, diagnosis or treatment, seek advice from an appropriately qualified health professional.

Where building, accessibility, safety, certification or regulatory compliance is relevant, obtain advice from the appropriate licensed or qualified professional for your project.

3. Design services and recommendations

Any design advice or recommendations we provide are based on the information available to us at the time and the agreed scope of the service.

Unless expressly included in writing, our services do not replace site inspections, engineering advice, building certification, medical advice, occupational therapy, legal advice, environmental testing or other specialist services.

Clients remain responsible for confirming dimensions, site conditions, product suitability, installation requirements, approvals, codes, standards and other project-specific requirements with the relevant supplier, contractor or qualified professional before purchasing, installing or constructing anything.

4. Courses, guides and digital products

Our courses, guides, workbooks, checklists, templates and other digital products are educational resources.

They are not personalised medical or clinical programs and do not promise a particular health, design, financial or other outcome.

Course and product descriptions are intended to explain the content and purpose of the resource.

Results depend on individual circumstances, implementation and other factors outside our control.

Digital access is for the purchaser’s personal or internal business use unless we expressly grant a different licence in writing.

5. Purchases and payment

Prices are displayed in Australian dollars unless stated otherwise.

Any applicable GST will be identified where required.

Payment may be processed by third-party payment providers.

We do not require customers to provide us with their full card details directly where payment is handled by a third-party processor.

If a product or service includes a subscription, recurring payment or trial, the price, billing frequency, renewal terms and cancellation process should be displayed before purchase.

By completing the purchase, you authorise the stated payment arrangement.

6. Consumer guarantees, refunds and cancellations

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

Our goods and services come with consumer guarantees that may apply automatically.

Where a product or service fails to meet an applicable consumer guarantee, you may be entitled to a remedy such as repair, replacement, refund, cancellation or compensation depending on the circumstances.

Any voluntary refund, change-of-mind or cancellation policy we publish is additional to, and does not replace, rights that apply under the Australian Consumer Law.

For refund or cancellation requests, contact hello@thbd.com.au with your order details and a brief explanation of the issue.

7. Intellectual property

Unless otherwise stated, content on this website and in The Healthy Building Designer courses, manuals, guides, downloads, graphics, branding, videos, text and other materials is owned by or licensed to Taluma Pty Ltd and is protected by applicable intellectual-property laws.

You may not copy, reproduce, republish, distribute, sell, sublicense, create derivative commercial products from, or publicly share our paid content without prior written permission, except where permitted by law.

You may download or print resources for the use permitted by the relevant product or service licence.

8. User submissions and communications

If you submit information, photographs, plans, documents, testimonials or other material to us, you confirm that you have the right to provide that material.

We will not publicly use a client’s private project material, testimonial, image or identifying information for marketing without the permission required for that use.

9. Third-party products, links and affiliate relationships

Our website may link to third-party websites, products, services or suppliers.

A link or recommendation does not mean we control the third party or guarantee its product, service, availability or suitability for every person or project.

Product specifications, formulations, prices and availability can change.

Check current information with the supplier before purchase or use.

Some links may be affiliate links, which means The Healthy Building Designer may receive a commission if you purchase through the link, at no additional cost to you.
